RockWise — Terms of Use

1. Introduction

Welcome to RockWise, a rock and mineral identification application and any related products or services owned or operated by Atrus Ltd (“Atrus”, “we”, “us”, or “our”) (collectively, the “RockWise Service”).

These Terms of Use (“Terms”) form a legally binding agreement between you (“you”, “User”) and Atrus Ltd governing your access to and use of the RockWise Service.

By accessing, installing, using, browsing, registering for, or subscribing to the RockWise Service, you confirm that you have read, understood, and agree to be bound by these Terms. If you do not agree, you must immediately discontinue use of the RockWise Service.

2. Eligibility

You must be at least 18 years old to use the RockWise Service. By using the Service, you represent and warrant that you meet this requirement.

You agree to use the RockWise Service in compliance with all applicable laws and regulations of the United Kingdom and any other jurisdiction that may apply to you.

3. Nature of the Service & No Professional Reliance

RockWise provides informational and educational content only.

While we make reasonable efforts to provide helpful and informative outputs, rock, mineral, and gemstone identification is inherently uncertain and may be inaccurate, incomplete, or incorrect.

You expressly acknowledge and agree that:

• RockWise does not provide professional, geological, gemological, valuation, insurance, investment, or commercial advice.
• Any results, identifications, descriptions, or analyses generated by RockWise must not be relied upon for commercial transactions, valuations/appraisals, insurance purposes, safety decisions, legal claims, or scientific/professional determinations.
• Any use of RockWise outputs is entirely at your own risk.

4. Changes to These Terms

We may update or modify these Terms from time to time. Continued use of the RockWise Service after changes are published constitutes acceptance of the revised Terms. You are responsible for reviewing the Terms periodically.

5. Limited Licence

Subject to these Terms, Atrus grants you a limited, revocable, non-exclusive, non-transferable, non-sublicensable licence to access and use the RockWise Service for personal, non-commercial purposes only. All rights not expressly granted are reserved by Atrus.

6. Ownership & Intellectual Property

All software, algorithms, models, designs, interfaces, text, graphics, logos, trademarks, and other materials forming part of the RockWise Service (“RockWise Materials”) are owned by or licensed to Atrus Ltd and are protected under UK and international intellectual property laws.

You may not:

• Copy, modify, distribute, sell, sublicense, reverse engineer, decompile, or create derivative works from any RockWise Materials.
• Use RockWise Materials for any commercial or competitive purpose.
• Remove or alter copyright or proprietary notices.

7. Acceptable Use & Restrictions

You agree not to:

• Use the RockWise Service for unlawful purposes.
• Interfere with or disrupt the Service or its infrastructure.
• Attempt unauthorised access to systems or accounts.
• Introduce malware, scraping tools, bots, spiders, or automated extraction systems.
• Circumvent paywalls, usage limits, or security mechanisms.
• Use RockWise in a way that could damage, overload, or impair the Service.

Any unauthorised use may result in immediate suspension or termination.

8. User Content

8.1 Responsibility for Your Content

You are solely responsible for any images, text, data, or materials you upload (“User Content”).

You represent and warrant that:

• You own or have the necessary rights to upload the User Content.
• Your User Content does not infringe third-party rights.
• Your User Content complies with applicable laws.

8.2 Licence to Atrus

By uploading User Content, you grant Atrus a worldwide, irrevocable, royalty-free, perpetual, transferable, and sublicensable licence to use, reproduce, modify, analyse, store, and display such content for the purpose of operating, improving, and developing the RockWise Service.

9. Account Security

You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. You must notify us immediately if you believe your account has been compromised.

10. Third-Party Services

RockWise may include links to third-party websites or services. Atrus does not control or endorse these third parties and is not responsible for their content, availability, or practices. Use of third-party services is at your own risk.

11. Suspension & Termination

We may suspend or terminate your access to RockWise at any time, with or without notice, if you breach these Terms, your use poses legal/technical/reputational risk, or we discontinue the Service (in whole or in part).

We are not liable for loss of data or content following termination.

12. Disclaimers

To the fullest extent permitted by law, the RockWise Service is provided “AS IS” and “AS AVAILABLE” without warranties of any kind. We do not guarantee that the Service will be accurate, reliable, uninterrupted, or error-free; that results will meet your expectations; or that defects will be corrected.

13. Limitation of Liability

To the maximum extent permitted by law, Atrus Ltd shall not be liable for any indirect, incidental, consequential, special, or punitive damages. Atrus Ltd’s total liability for all claims arising out of or relating to the RockWise Service shall not exceed £100 GBP.

Nothing in these Terms excludes or limits liability that cannot be excluded under UK law (including liability for death or personal injury caused by negligence, fraud, or fraudulent misrepresentation).

14. Indemnity

You agree to indemnify and hold harmless Atrus Ltd from any claims, losses, damages, liabilities, and expenses arising from your misuse of the RockWise Service, your breach of these Terms, or your User Content.

15. Governing Law & Jurisdiction

These Terms are governed by and construed in accordance with the laws of England and Wales. You agree that the courts of England and Wales shall have exclusive jurisdiction over any disputes arising from or relating to these Terms or the RockWise Service.

16. Apple App Store Terms

If you access RockWise via the Apple App Store:

• These Terms are between you and Atrus Ltd, not Apple.
• Apple has no responsibility for the Service or its content.
• Apple is a third-party beneficiary of these Terms and may enforce them against you.

17. Miscellaneous

• Severability: If any provision is held unenforceable, the remainder remains in effect.
• Assignment: Atrus may assign these Terms without restriction.
• Entire Agreement: These Terms constitute the entire agreement between you and Atrus relating to the RockWise Service.
